1. Agreement to Terms

By accessing or using Linkiz, the AI front desk operated by AImasterz LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

AImasterz provides Linkiz, an AI front desk for local practices. Linkiz:

• Texts back missed callers when calls are routed into Linkiz
• Sends appointment reminders with consent and opt-out handling
• Sends post-visit review request SMS using the customer's configured review link
• Includes website chat grounded in the customer's own published content

Founding practices may start with a 14-day trial. Stripe Checkout collects a payment method before the trial starts. After the trial, the founding price is $297 per location per month unless a separate written agreement says otherwise. We make no guarantees as to specific results.

3. User Responsibilities

You agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your account credentials
• Use our services only for lawful purposes
• Not interfere with or disrupt our services
• Comply with all applicable laws and regulations
• Keep your website, hours, services, pricing, and booking details current
• Confirm that you own or control the website content connected to Linkiz and may allow Linkiz to read and index its public pages

4. SMS and Phone Workflows

Linkiz supports operational SMS workflows such as missed-call follow-up, appointment reminders, and post-visit review requests. Before Linkiz sends texts to a person on your behalf, you must have the consent or other legal basis required for that message type and keep appropriate records.

• Do not use Linkiz to send unlawful, misleading, or unsolicited texts.
• Do not upload rented, purchased, or shared opt-in lists.
• Linkiz includes STOP/START/HELP-style handling for SMS opt-out, opt-in, and help requests. If someone asks to stop by another reasonable method, such as calling or emailing your office, you must honor that request and update the relevant records before further automated sends.
• A2P 10DLC or similar carrier registration may apply before SMS is enabled. You must provide accurate business, campaign, consent, and sample-message information for registration and ongoing compliance.

5. Payment Terms

Pricing: All prices are in USD unless otherwise specified. Founding-practice pricing is $297 per location per month after the 14-day trial unless a separate written agreement says otherwise.

Payment: Checkout and subscription billing are processed by Stripe. Stripe Checkout collects a payment method before the trial starts. You can cancel before the trial ends to avoid the first subscription charge.

Late Payments: Late payments may incur additional fees and may result in suspension of services.

6. Intellectual Property

Our IP: All content, features, and functionality of our website and proprietary tools remain the exclusive property of AImasterz.

Client IP: You retain ownership of your business content, leads, and pre-existing intellectual property. You grant us the limited permission needed to read your public site, index it, operate Linkiz, and deliver leads and SMS workflows for your account.

7. Confidentiality

We handle customer data and business information confidentially. We may disclose it to the subprocessors and service providers needed to operate Linkiz, as described in the Privacy Policy, or when required by law, with your consent, or as needed to protect the service and our rights.

8. Limitation of Liability

To the maximum extent permitted by law, AImasterz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claim arising from or relating to these terms shall not exceed the amount paid by you to us in the 12 months preceding the claim.

9. Warranty Disclaimer

Our services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

10. Termination

Either party may terminate services according to the terms specified in the service agreement. We reserve the right to suspend or terminate access to our services for violation of these terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any dispute shall be subject to the exclusive jurisdiction of the state and federal courts located in King County, Washington.
